MEMORANDUM FOR LT DAN RIGTERINK, NMPC 06P

SUBJ: LAFAYETTE RONALD HUBBARD; FOIA REQUEST OF

Ref: (a) Mr Joel Sappell’s request of the 9th of September 1986

1. Reference (a) is forwarded as a matter under your cognizance. The major difficulty that this officer has with the Hubbard case is that we do not have copies of the letters sent out in the past in reply to the numerous FOIA requests which have been done. It is very difficult for us to respond to this type of request when those papers are not filed down in the record.

2. The second area of difficulty revolves around Mr Hubbard’s Naval Medical Record. Our records indicate that this is a combined record (meaning that both the Personnel and the Medical Records are stored together) and that Mr Hubbard’s Naval Medical Record was most probably forwarded to Brian Robertson on the 25th of July 1986, but it was not noted on our control card. We know that when the record was returned to this office only the Personnel Record was returned and the Medical Record was not there. Could Brian have sent the Naval Medical Record to the Naval Medical Command for a response? This we do not know. Have looked in all locations where Mr Hubbard’s Naval Medical
Record could be stored out here and it is not here.

3. Finally, the statement that “dead people don’t have no privacy” is a difficult one for us to clarify out here into a working procedure. If you could provide further direction here, it would be most helpful.

4. Call if there are any questions on the above, or if you find Mr Hubbard’s Naval Medical Record. As you can see by my response to Mr Sappell, I am still on the hook for that Medical response.
